Project: Mural Design and Installation ServicesThis agreement forms part of the contract between My Big Imagination CIC ("the Artist") and the Client commissioning a mural project.1. PurposeThe Artist is committed to delivering high-quality mural artwork while maintaining safe working practices, safeguarding standards, and accurate project documentation.By commissioning the project, the Client agrees to the terms outlined below.

2. Site Access and Safety

The Client agrees to:

  • Provide safe access to the mural location throughout the project.

  • Inform the Artist of any known hazards, risks, site restrictions, or health and safety requirements.

  • Ensure the work area is suitable for artistic activities.

  • Obtain any permissions required from landlords, property owners, local authorities, or third parties before work begins.

  • Restrict unauthorised access to the work area where appropriate.

The Artist reserves the right to suspend work where safety concerns arise.

3. Safety Personnel

The Artist may appoint a designated Safety Assistant to support the delivery of the project.

The Safety Assistant may:

  • Monitor safe working practices.

  • Assist with risk assessments.

  • Manage public interactions around the work area.

  • Support safeguarding procedures.

  • Assist with emergency response if required.

The Client agrees to allow the Safety Assistant access to the site for the duration of the project.

4. Photography, Filming and Project Documentation

The Client acknowledges that the Artist may document the project through:

  • Photography

  • Videography

  • Drone footage (where legally permitted)

  • Audio recording

  • Interviews

  • Time-lapse recording

  • Livestreaming

  • Social media content

The Client grants permission for the Artist to capture and use project documentation before, during, and after completion. No filming of minors permitted.

Such content may be used for:

  • Portfolio purposes

  • Marketing and promotion

  • Social media

  • Educational resources

  • Funding applications

  • Award submissions

  • Press coverage

  • Website content

  • Training materials

  • Community engagement activities

5. Body-Worn Cameras and Microphone Use

For safeguarding, security, project documentation, training, and quality assurance purposes, the Artist and authorised representatives may wear:

  • Body-worn cameras

  • Microphones

  • Audio recording devices

  • Project monitoring equipment

Recordings may be retained where necessary for:

  • Incident reporting

  • Safeguarding concerns

  • Insurance requirements

  • Legal compliance

  • Project evaluation

  • Internal training

6. Location Tracking and Geolocation

The Client acknowledges that:

  • Project locations may be documented.

  • GPS-enabled devices may be used during project delivery.

  • Photographs and videos may contain geolocation metadata.

  • Public-facing content may identify the mural's location unless otherwise agreed in writing.

Where confidentiality is required, this must be agreed before project commencement. Personal data is destroyed after completion of the project.

7. Public Interaction and Safeguarding

Where projects involve schools, young people, vulnerable adults, or members of the public:

  • The Client agrees to support safeguarding procedures.

  • Appropriate supervision must be provided where required.

  • Participants may be photographed or filmed only where suitable consent arrangements are in place.

The Artist reserves the right to stop activities if safeguarding concerns arise.

8. Insurance and Liability

The Artist maintains appropriate insurance coverage for mural activities.

The Client remains responsible for:

  • The safety of the site itself.

  • Existing building defects.

  • Damage caused by third parties.

  • Securing permissions for the mural location.

The Artist shall not be liable for delays or interruptions caused by weather, site access restrictions, health and safety concerns, vandalism, utility failures, or circumstances beyond reasonable control.

9. Intellectual Property

Unless otherwise agreed in writing:

  • The Artist retains copyright and intellectual property rights relating to original mural designs.

  • The Client receives a licence to display the completed mural at the agreed location.

  • The Artist may photograph and reproduce images of the mural for portfolio, educational, promotional, and commercial purposes.

The Client shall not reproduce, alter, sell, or commercially exploit the mural design without written permission from the Artist.

Stickers or freebies gifted during completion are not for re-sale. The Client shall not reproduce, alter, sell, or commercially exploit the mural design without written permission from the Artist.

10. Completion and Maintenance

Upon completion:

  • Responsibility for ongoing maintenance transfers to the Client.

  • The Artist is not responsible for future deterioration caused by weather, vandalism, structural movement, or environmental conditions.

  • Any future repairs, restoration work, or modifications will be subject to separate agreement and fees.

11. Acceptance of Terms

By commissioning the mural project, the Client confirms that they:

  • Have authority to approve the work.

  • Have obtained any necessary permissions.

  • Understand and accept the safety, recording, safeguarding, and documentation procedures outlined above.

  • Consent to photography, videography, body-worn camera use, audio recording, and location documentation in connection with the project.

Sticker sales and free gifts, Safety and Media Agreement

1. Copyright Ownership

All sticker designs, artwork, illustrations, graphics, logos, characters, slogans, and freebie creative content remain the intellectual property and copyright of My Big Imagination CIC unless otherwise agreed in writing.

The purchase of physical or digital stickers does not transfer copyright ownership.

All rights not expressly granted are reserved by the Supplier.

2. Permitted Use

The Client is granted a non-exclusive, non-transferable licence to:

  • Use purchased stickers for personal, educational, promotional, or agreed business purposes.

  • Display stickers on personal belongings, vehicles, equipment, displays, packaging, or approved marketing materials.

  • Distribute stickers where expressly authorised by the Supplier.

3. Restrictions on Resale and Licensing

The Client shall not:

  • Resell sticker designs as standalone products.

  • Reproduce stickers for sale.

  • Copy, scan, trace, redraw, modify, or recreate the artwork.

  • Create derivative works based on the designs.

  • License, sublicense, lease, rent, transfer, or distribute the designs to third parties.

  • Upload the designs to print-on-demand services, marketplaces, stock image websites, or digital download platforms.

  • Use the artwork to create merchandise without written permission.

  • Register the designs, trademarks, or artwork as their own intellectual property.

Any commercial use beyond the original authorised purpose requires prior written consent from My Big Imagination CIC.

4. Digital Files

Where digital files are supplied:

  • Files may only be used by the named Client.

  • Files must not be shared, copied, sold, transferred, or distributed.

  • The Client must take reasonable steps to prevent unauthorised access or reproduction.

5. Commercial Licensing

Any use involving:

  • Product sales

  • Merchandise

  • Retail distribution

  • Licensing arrangements

  • Manufacturing

  • Wholesale activities

requires a separate written licensing agreement and may incur additional fees.

6. Breach of Agreement

Any unauthorised reproduction, resale, licensing, modification, distribution, or commercial exploitation of the sticker designs may constitute copyright infringement.

The Supplier reserves the right to:

  • Revoke any licence granted.

  • Seek removal of infringing products.

  • Recover damages, legal costs, and lost revenue.

  • Pursue any other remedies available under UK intellectual property law.

7. Acknowledgement

The Client acknowledges that:

  • Copyright remains with My Big Imagination CIC.

  • No ownership rights are transferred through purchase.

  • The sticker designs may not be copied, resold, licensed, or reproduced without written permission.

  • Any permitted use is subject to the terms of this agreement.
